Town and village courts handle traffic violations, small claims, and misdemeanors at the local level. These are the courts where most traffic tickets are heard. Newport Town Court, for example, is at 2287 West Street, Newport, NY 13416 (mailing: PO Box 494). Phone is 315-845-8667. It handles tort and contract cases, real property matters up to $3,000, small claims up to $3,000, misdemeanors, preliminary hearings, and traffic violations.

Herkimer Town Court is at 114 North Prospect Street, Herkimer, NY 13350. Court sessions are every Tuesday at 1:30 PM and 6:00 PM with alternating judges. The court clerk is available Monday, Wednesday, and Thursday from 9:00 AM to 5:00 PM (except holidays). On Tuesdays, the clerk is in from 9:00 AM to 7:00 PM to cover the evening court session.

This is one of the busiest local courts in the county. Speeding is the most common charge. If you got a ticket in the Town of Herkimer, this is where your case will be heard. Call the clerk to confirm your court date and what you need to bring. If you plan to plead not guilty, you will need to appear at one of the Tuesday sessions or arrange a hearing date through the clerk.

Speeding Fines and Points

Speeding convictions in New York carry points that range from 3 to 11. The breakdown works like this: 1 to 10 mph over the limit is 3 points, 11 to 20 mph over is 4 points, 21 to 30 mph over is 6 points, 31 to 40 mph over is 8 points, and more than 40 mph over is 11 points. That last one -- 11 points -- can trigger a license suspension all by itself.

First-time speeding offense fines in New York are set by law. Going 10 mph or less over the limit costs $45 minimum, $150 maximum, plus a surcharge of $88 or $93. Going 11 to 30 mph over runs $90 to $300, with up to 30 days in jail possible, plus the surcharge. More than 31 mph over the limit can cost $180 to $600, with up to 30 days possible, plus the surcharge. These are minimums and maximums -- the actual fine depends on the judge.

If you hit 6 points in 18 months, you owe the Driver Responsibility Assessment -- $100 per year for three years, plus $25 per year for each point over 6. A defensive driving course removes up to 4 points and saves 10 percent on insurance for three years.
