The Columbia County DA's website explains the plea bargain process, eligibility, and how to submit a request.

Some charges are NOT eligible for plea bargains. These include VTL 1144(a) Failure to Yield to Emergency Vehicle, VTL 1229c child safety restraint violations, and VTL 1174 Failure to Stop for School Bus. Alcohol-related offenses, drug-related offenses, and Aggravated Unlicensed Operation charges are also excluded. You have no right to a reduction. The DA may or may not offer you a deal.

Processing takes more than six weeks. You need to submit your request well in advance of your next court date. You must also contact the court separately to request an adjournment -- submitting a plea bargain request does not automatically excuse you from court appearances. If you get an offer and accept it, sign and submit the agreement to the court promptly. Delays can result in license suspension. The judge makes the final call on whether to accept the plea and sets the fine amount. You will get at most one offer. If you reject it, or if the court rejects it, the DA will not make another. Plea agreements must be sent by regular U.S. mail, not email. The DA's office does not have copies of traffic tickets, so don't ask them for one.

Points and Penalties

Traffic violations in Columbia County follow the same point system as the rest of New York. The NYS Driver Point System page has the full details. Points accumulate over 18 months. Hit 11 points and your license is suspended. Three speeding convictions in 18 months also triggers suspension, no matter the point total. A defensive driving course removes up to 4 points and cuts your insurance by 10% for three years.

The Return the F.A.V.O.R. Veteran Discount Program is available for veterans through the Clerk's office. Pistol permit recertification must be done online through the NYS Police -- Possess on Premises permits every 5 years, Concealed Carry permits every 3 years. These are not traffic-related but are common services the Clerk provides.
